As recently “Rzeczpospolita” has reported, the deans of all bar councils in Poland appealed to the Ministry of Justice demanding the creation of special departments or sections for foreign currency loans in all district courts.
“Banking cases require specialist legal knowledge, and their number on a national scale allows for the treatment of legal disputes related to mortgage as a socially significant, vital from the state perspective” – emphasizes the appeal of the deans to the minister.
At the same time, the deans have indicated that consumers’ right to take advantage of the so-called the commutative property allows them to bring an action against the bank according to their place of residence. In such case, to secure the enjoyment of such right, new divisions should be created.
